What is a Trademark Search & Why It Matters
A trademark search checks the IP India register for existing marks that are identical or similar to the brand name you want to protect. Filing without searching is the most common reason applications are objected to or refused — the examiner will cite conflicting marks under Section 11 of the Trade Marks Act, 1999, and opposition by an existing owner can add months or years to the process.
Did You Know?
- Class-Specific Protection: A trademark is registered per Nice class. The same word can be owned by different businesses in different classes.
- First to Use Matters: India recognises prior use, so a search also helps you gauge how long a conflicting mark has been on the register.
- Preliminary, Not Conclusive: A free word-mark search catches identical marks; phonetically or visually similar marks need an attorney-led comprehensive search.
Word Mark Search
Search the register for your exact brand name and see every matching application with its current status.
Class Filtering
Narrow results to the Nice class your goods or services fall under — conflicts outside your class often do not block registration.
Status Reading
Registered, opposed, objected, abandoned — each status changes what the mark means for your filing strategy.
When to Run a Trademark Search
Naming a New Brand
Shortlist names, search each one, and pick the candidate with a clear register before committing to design work.
Before Filing an Application
Confirm the mark is clear in your class so the application survives examination without conflict objections.
Expanding Product Lines
Entering a new category usually means a new Nice class — check it before you launch under the same brand.
