Under the Designs Act, 2000, a design can be registered if it: 1) Relates to features of shape, configuration, pattern, ornament, or composition of lines or colors, 2) Is applied to any article (2D or 3D), 3) Is applied by any industrial process, 4) Appeals solely to the eye, 5) Is new or original. What CANNOT be registered: Mere mechanical devices (protected by patents), Trademark or property mark (protected by trademark law), Artistic works like paintings (protected by copyright), Designs contrary to public order or morality.

The Locarno Classification is an international system for classifying industrial designs, established by the Locarno Agreement (1968). Design registration in India is valid for an initial period of 10 years from the date of registration. This can be extended by an additional 5 years by filing for renewal before the expiry of the initial term. Total maximum protection: 15 years. Important dates: Registration date (not filing date) determines expiry, Renewal must be filed before expiry, Grace period of 6 months for late renewal with surcharge, Restoration possible within 1 year of lapse. After expiry, the design enters public domain and can be freely used by anyone.

Design and patent protect different aspects of a product: Design Protection: Protects the ornamental or aesthetic appearance (how it looks), Must be new and original, Valid for 10+5 years, No examination of functionality, Relatively faster and cheaper, Protects against copying of appearance. Patent Protection: Protects the technical invention (how it works), Must be novel, inventive, and industrially applicable, Valid for 20 years, Rigorous substantive examination, Longer and more expensive process, Protects against making/using/selling the invention. A product can have BOTH: iPhone has design patents (appearance) and utility patents (technology).

A prior art search investigates whether your design has been previously published or registered anywhere in the world. It includes: Search of Indian Design Office records, International design databases (WIPO, EUIPO, USPTO), Published catalogues and materials, Prior public use or knowledge. India allows 'multiple design' filing in certain circumstances: Same design applied to different classes: You can file the same design in multiple classes through separate applications. Different designs in same class: Multiple designs can be filed in a single application if they are variants of the same concept (called 'set of articles'). For example: A tea set (cup, saucer, pot) with matching design can be filed together. However: Each design must be separately registrable, Different designs usually require separate applications, Government fees apply per design. Process to respond: 1) Analyze objections carefully, 2) Prepare detailed response with arguments, 3) Submit evidence of novelty (affidavits, declarations), 4) Amend application if possible, 5) Request hearing if needed. Yes, India offers a 'secret design' provision: You can request non-publication of your design for up to 2 years from the filing date. How it works: Request secret design at time of filing or within specified period, Design remains unpublished in records, Publication occurs automatically after 2 years or upon your request, Same registration rights apply. Piracy of registered design means: Fraudulent or obvious imitation of a registered design for sale, Importing for sale articles bearing pirated designs, Publishing or exposing for sale articles with pirated design. Penalties for piracy: Civil remedy: Injunction and damages up to ₹50,000 per contravention (recoverable as contract debt), Criminal penalty: Fine up to ₹25,000 and/or imprisonment up to 6 months for first offense; Fine up to ₹50,000 and/or imprisonment up to 1 year for subsequent offenses. To enforce: Send cease and desist notice, File civil suit for injunction, File criminal complaint, Seek customs protection against imports.
